By accessing our website, purchasing our products (including Tick sensor devices), using our services (including the Twin cloud API), or reading our publications (including the Seer Frights book series), you agree to be bound by these Terms.

5.1 Supervision Requirement: The build-it projects described on this website require adult supervision. No one should build alone.

5.3 Adult Supervision: Projects may involve small components, batteries, soldering tools, or programmable electronic devices. Adult supervision is required.
5.4 Assumption of Risk: Build-it projects involve electronic components, tools, and materials that carry inherent risks. YOU ASSUME ALL RISK associated with building, testing, and using any device described on this website.
5.5 No Warranty of Safety: While we strive to provide accurate instructions, we do not guarantee that any project is free from error, risk of injury, or property damage. Always follow manufacturer safety guidelines for all components.
6.1 Your Data: You retain ownership of all data you collect, store, or transmit using our products and services ("Your Data"). You grant i4Seer a limited license to process Your Data solely to provide the services.

7.1 Our IP: All intellectual property rights in our products, services, website, firmware, software, publications, documentation, and trademarks belong to i4Seer. "Tick," "Seer Frights," and "i4Seer" are trademarks of Institute for Seer, LLC.
7.2 License: We grant you a limited, non-exclusive, non-transferable license to use our products and services in accordance with these Terms. This license does not include the right to modify, copy, distribute, or create derivative works.
7.3 Book Content: The Seer Frights book series, including all characters, storylines, and illustrations, is protected by copyright. Reproduction, distribution, or adaptation without written permission is prohibited.
7.4 Custom Work: Unless otherwise agreed in writing, custom firmware and software developed by i4Seer for clients remains the property of i4Seer, with a license granted to the client for their use.
If you submit feedback, suggestions, or other content to us, you grant i4Seer a perpetual, worldwide, royalty-free license to use, modify, and incorporate such content into our products and services without compensation or attribution.
9.1 Availability: We strive to maintain high availability of our cloud services but do not guarantee uninterrupted access. Services are provided on an "as available" basis.
9.2 Modifications: We may modify, suspend, or discontinue cloud services at any time with reasonable notice when possible.
9.3 Data Retention: Upon termination of your account, we may delete Your Data after a reasonable retention period. You are responsible for exporting data before termination.
10.1 Orders: All orders are subject to acceptance by i4Seer. We reserve the right to refuse or cancel orders.
10.2 Pricing: Prices are subject to change without notice. Shipping and taxes are additional unless otherwise stated.

11.1 Limited Warranty: Hardware products are warranted against manufacturing defects for one (1) year from the date of purchase.

13.3 These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if i4Seer has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless i4Seer, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
15.1 Third-Party Pricing: Prices, shipping, taxes, and availability are determined by third-party sellers and may change without notice. Institute for Seer LLC is not responsible for order fulfillment, returns, or warranties provided by third-party sellers.
15.2 Hardware Products: Hardware referenced or linked on this website (including the ATOM Matrix and electronic components) is a general-purpose electronics device for educational use. You are responsible for safe handling, setup, and compliance with all applicable safety and regulatory requirements.
15.3 Wireless Compliance: Radio features and wireless use must comply with local regulatory requirements (e.g., FCC in the U.S.). You are solely responsible for ensuring your use of any wireless-enabled device complies with all applicable laws and regulations in your jurisdiction.
15.4 No Agency: Links to third-party sellers (including Amazon, M5Stack, Mouser, and others) are provided for convenience. i4Seer is not an agent, distributor, or representative of any third-party seller. Your purchase from a third-party seller is governed by that seller's terms and policies.
Our products and services may integrate with or link to third-party services. We are not responsible for third-party services and disclaim all liability related to your use of them.

19.1 Governing Law: These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.
19.2 Jurisdiction: Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Kentucky, and you consent to the personal jurisdiction of such courts.

20.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and i4Seer.
20.2 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
20.3 No Waiver: Failure to enforce any right does not waive that right.
20.4 Assignment: You may not assign these Terms. i4Seer may assign these Terms without restriction.
20.5 Force Majeure: i4Seer is not liable for delays or failures due to circumstances beyond our reasonable control.
